The Union Cabinet late on Thursday approved a proposal to amend the Constitution to restore reservation for Scheduled Castes and Scheduled Tribes in unaided private professional educational institutions.The Constitution Amendment Bill 2005 would be introduced in the winter session of Parliament, Union parliamentary affairs minister Priya Ranjan Dasmunshi told mediapersons. The amendment would enable the states to make reservation of seats for socially and educationally backward classes or for SCs and STs in educational institutions including unaided private professional educational bodies, other than minority institutions, and to regulate their admission and fee, he said. The states would enact their own laws according to their own requirements, Dasmunshi said. Observing that there was a comprehensive consensus and total unity among political parties on the issue, he said the government expected that the Bill would be passed in this session itself. He said the measure need not go to the Parliamentary Standing Committee in view of the unanimity as well as due to the delay it would cause to the fresh admissions scheduled soon. Asked whether the Cabinet decision would go against the Supreme Court order on reservation, Dasmunshi said, We are not questioning the judgment of the Supreme Court but Parliament is competent to legislate. Parliament is supreme in this matter. To a question on the exclusion of minority institutions, he said the rights of minority institutions were guaranteed by the Constitution and they are already enjoying the status.

Justice Arun Tan-don of Allahabad High Court on 4 Oct quashed the Aligarh Muslim University (AMU) Amendment Act, 1981, which provides that AMU is a minority institution, setting the stage for yet another politically charged controversy round of quotas in educational institutions and putting what has traditionally been a politically divisive issue back on the front burner. With Other Indian Institutes of Management (IIMS) planning to amend the Memorandum of Association (MOA) to enable them to expand overseas, IIM Calcutta has decided not to follow suit as the institute does not have any immediate plan to foray abroad.
